Greer Injury Lawyers Joins Federal Class Action Over Memphis-Area Data Center Noise

Understanding the federal class action lawsuit filed against X.AI Corp. and MZX Tech LLC on behalf of southern Memphis residents

On September 23, 2026, Lieff Cabraser Heimann & Bernstein LLP and Greer Injury Lawyers PLLC filed a federal class action lawsuit in Tennessee against X.AI Corp. and MZX Tech LLC on behalf of southern Memphis residents impacted by xAI’s massive data centers and the gas-turbine power plant that fuels them. Residents allege that noise, vibration, dust, ash, and other particulate matter from the facilities have interfered with their ability to use and enjoy their properties and diminished their property values.

We’re posting this article to provide an overview of the allegations in the lawsuit and the impact residents say these facilities have had on their community.

What prompted the lawsuit

For decades, residents of southern Memphis enjoyed the calm and quiet of their community. According to the complaint, that changed in mid-2025, when X.AI Corp. and MZX Tech LLC began operating gas-fired turbines to power large AI data centers near the Mississippi and Tennessee border. The first two data centers, “Colossus I” and “Colossus II,” are located in Memphis. The complaint also states that the defendants are building two additional data centers, “MACROHARDRR” and “Minihard.”

According to the complaint, the number of gas-fired turbines on site increased from 3 to 18 between August and September 2025, after community members had already raised concerns about the constant noise with the media, police, and local government. The number later increased to 27 and eventually to 69. The defendants have relied on these “temporary” turbines for the last year and indicate they will continue to rely on them at least until July 2027.

“Nobody moves to a quiet, family-oriented neighborhood to be jolted awake by roaring turbines at night, or to live with their windows shut,” said Thomas Greer of Greer Injury Lawyers. “These families were here first. They deserve their homes back.”

Residents describe persistent and intrusive noise from the facilities 24 hours a day, 7 days a week, including high-pitched squealing, continuous engine roaring, low-frequency rumbling, and tonal humming or whining that travels across property lines and into area homes. Residents also report physical vibrations and dust, ash, and other particulate matter settling on cars and outdoor furniture and being carried indoors when doors and windows are opened.

What the lawsuit claims

  • The class action lawsuit includes allegations of:
  • Violations of local noise ordinances
  • Private nuisance
  • Public nuisance
  • Negligence and negligence per se
  • Trespass

The lawsuit seeks actual, compensatory, statutory, consequential, and punitive damages, abatement of the nuisance, and injunctive relief requesting that the Court order the defendants to cease operations unless they can do so without harming the community.

The impact on residents

According to the complaint, the constant noise and accompanying vibration interfere with residents’ daily lives and well-being. Residents say the noise disrupts sleep and prevents the ordinary use and enjoyment of indoor and outdoor living spaces. Activities such as sitting or dining outside, opening windows, relaxing indoors, or resting at night have been materially impaired or rendered impossible by the continuous industrial noise and vibration.

A community seeking relief

The lawsuit alleges that the facilities have interfered with residents’ ability to use and enjoy their properties and seeks relief intended to address the ongoing nuisance and harm described in the complaint.
